The House Health and Human Resources Committee moves to amend
the bill on page two, section two, line sixteen, following the word
"an" by deleting the word "the";
On page three, section three, line twenty-one by deleting the
letter "(b") and the word"Provided" and inserting in lieu thereof
the following: "(c) Provide"; and
On page four, section five, line seventeen, following the word
"rule"and the period by adding the following:
"§16-4D-6.Confidentiality of Screening Tool.
(a) The uniform maternal screening tool shall be confidential
and shall not be released or disclosed to anyone including any
state or federal agency for any reason other than data analysis of
high=risk and at-risk pregnancies for planning purposes by public
health officials.
(b) Proceedings, records and opinions of the Advisory panel
are confidential and are not subject to discovery, subpoena or
introduction into evidence in any civil or criminal proceeding.
Nothing in this subsection is to be construed to limit or restrict
the right to discover or use in any civil or criminal proceeding
anything that is available from another source and entirely
independent of the proceedings of the Advisory panel.
(c) Members of the Advisory panel may not be questioned in any
civil or criminal proceeding regarding information presented in or
opinions formed as a result of a meeting of the panel. Nothing in
this subsection may be construed to prevent a member of the Advisory panel from testifying to information obtained
independently of the panel or which is public information."
And,
On page one, line twenty by striking out the enacting clause
and inserting in lieu thereof the following:
"
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §16-4E-1, §16-4E-2,
§16-4E-3, §16-4E-4, §16-4E-5 and §16-4E-6, all to read as follows:"
